Avoiding probate and ensuring that property passes to loved ones with a minimum delay are two of the reasons why estate planning is a good idea.

Probate is the legal process by which a person's debts are paid and assets are distributed upon her or his death.  I advise my clients to avoid probate whenever possible.  Probate proceedings can be expensive and time-consuming.  In addition, your privacy is taken away by exposing your family’s private financial matters to the court system.

At the Orwin Law Office, I use revocable and irrevocable trusts, life insurance trusts, special needs trusts, gifting and other estate planning documents to simplify or avoid probate.  I also help clients write living wills and health care directives.  These documents allow you determine, while you are still healthy and competent, what steps should be taken to sustain your life should your health deteriorate.  I also help clients prepare powers of attorney so you can place the management of your financial affairs with a trusted family member.  I tailor your estate plan for your personal situation – whether you have significant tax concerns or whether estate taxes are not an issue.  I have written thousands of wills and hundreds of estate plans.  I know the law as well as how to structure estate planning so it creates the least amount of problems for the beneficiary.

I represent clients in probate proceedings, paying legitimate bills and expenses and distributing the remainder of the estate according to the terms of the decedent's will.  Good legal advice and guidance can expedite the probate process, prevent costly errors, and protect the executor (or the administrator, in cases where there is not a will) from being sued.

I also represent people who are contesting wills and probate proceedings, including:

  • Spouses who do not receive an appropriate share of their partner’s estate.
